Platform Terms of Use — Dog Trainer Index

Introduction

Important — Please Read Carefully. These Terms and Conditions govern your use of the Dog Trainer Index platform. By accessing or using the platform, submitting your information, or receiving communications from us, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

These Terms and Conditions (‘Terms’) are entered into between Dog Trainer Index Limited (‘Dog Trainer Index’, ‘we’, ‘us’, or ‘our’), a company incorporated (or in the process of incorporation) in New Zealand, and any person who accesses or uses our platform, website, or services (‘you’ or ‘User’).

Dog Trainer Index operates as an online lead generation and marketing platform connecting prospective clients (‘Prospects’) with dog service providers (‘Service Providers’) including but not limited to dog trainers, dog walkers, dog groomers, and dog daycares.

Our platform is accessible via www.dogtrainerindex.co.nz and www.dogtrainerindex.com (collectively, the ‘Platform’).

Definitions

In these Terms, unless the context otherwise requires:

Acceptance of Terms

By using the Platform in any way — including but not limited to submitting an enquiry form, registering your interest, or clicking to indicate acceptance — you confirm that:

• You are 18 years of age or older, or have the consent of a parent or guardian;
• You have read, understood, and agree to be bound by these Terms;
• You have read and understood our Privacy Policy, which forms part of these Terms; and
• You consent to the collection, use, and disclosure of your personal information as set out in these Terms and our Privacy Policy.

These Terms may be updated from time to time. We will publish the updated Terms on the Platform with the revised effective date. Your continued use of the Platform following any such update constitutes your acceptance of the revised Terms.

The Platform — What We Do

4.1 Lead Generation Service

Dog Trainer Index operates as a lead generation intermediary. When you submit your information through the Platform, we collect your details and pass them to one or more relevant Service Providers in your area or matching your stated needs.

4.2 Marketing Services

By submitting your details and providing the relevant consents, you may receive Marketing Communications from Dog Trainer Index on behalf of Service Providers. These may include:

• Promotional offers and discounts from Service Providers;
• General content relating to dog care, training, and welfare;
• Service Provider spotlights, news, and announcements;
• Dog Trainer Index platform updates and announcements; and
• Third-party advertising content from businesses that have paid for placement in our communications.

4.3 Advertising

Dog Trainer Index generates revenue in part through advertising. Service Providers and other relevant businesses may pay to have their content featured prominently in our marketing emails, on the Platform, or in other communications. You acknowledge that some content you receive through the Platform may be paid promotional material. Where required by law, such content will be identified as advertising.

4.4 We Are a Platform, Not a Service Provider

Dog Trainer Index is not itself a dog training, grooming, walking, or daycare service. We do not guarantee the quality, suitability, credentials, or conduct of any Service Provider listed on or connected through the Platform. Any engagement you enter into with a Service Provider is entirely between you and that Service Provider.

Information You Provide

5.1 Accuracy

You agree to provide accurate, complete, and up-to-date information when using the Platform. You must not submit false, misleading, or fraudulent information.

5.2 Types of Information Collected

The types of personal information we may collect from Prospects include:

• Your full name;
• Contact details including email address, phone number, and physical address or suburb;
• Information about your dog(s) including breed, age, and general health or behavioural notes; and
• Your service interests, including interest in services relating to specific conditions (such as anxiety, incontinence, or behavioural issues).

Please note that information about specific health-related interests for your dog (e.g., anxiety management, incontinence) will be treated with additional care. This information will only be shared with Service Providers for the purpose of matching you with appropriate services.

5.3 Your Responsibilities

You are responsible for any information you submit. If any of your details change, you may contact us at hello@dogtrainerindex.co.nz to update your information.

Sharing Your Information with Service Providers

When you submit an enquiry through the Platform, you expressly acknowledge and consent to your Lead information (including your name, contact details, location, and dog details) being passed to one or more Service Providers who Dog Trainer Index considers relevant to your enquiry.

You acknowledge and understand that:

• Service Providers will receive your contact information and may contact you directly;
• Service Providers are independent third parties and are not employees or agents of Dog Trainer Index;
• Once your information is passed to a Service Provider, that Service Provider’s own privacy practices will govern their use of your information;
• Dog Trainer Index cannot control and is not responsible for how Service Providers use, store, or protect your information after it has been disclosed to them; and
• You may receive multiple responses from Service Providers as a result of your single enquiry.

Dog Trainer Index takes reasonable steps to ensure Service Providers are reputable and legitimate; however, we do not guarantee or warrant the conduct of any Service Provider.

Marketing Communications and Consent

7.1 Consent to Receive Communications

By submitting your details and providing the appropriate consent on the Platform, you agree to receive Marketing Communications from Dog Trainer Index. We will only send you Marketing Communications where we have obtained your consent in accordance with the Unsolicited Electronic Messages Act 2007 (UEMA).

7.2 Nature of Communications

Marketing Communications may be sent on behalf of Dog Trainer Index or on behalf of Service Providers who have engaged Dog Trainer Index for marketing services. Communications may contain:

• Promotional content from Service Providers;
• General dog care and lifestyle content;
• Offers, discounts, and competitions; and
• Paid advertising content from third-party advertisers.

7.3 Unsubscribe

Every Marketing Communication we send will include a clear and functional unsubscribe mechanism. You may unsubscribe at any time by:

• Clicking the unsubscribe link in any email you receive from us;
• Emailing us at privacy@dogtrainerindex.co.nz; or
• Contacting us via the Platform at www.dogtrainerindex.co.nz.

We will process unsubscribe requests promptly and in any event within 5 working days, in compliance with the UEMA. Unsubscribing from marketing communications will not affect any service-related communications we are required to send you.

7.4 Your Communication Preferences

You may update your communication preferences at any time. We will honour all preferences and consents in accordance with the Privacy Act 2020 and the UEMA.

Service Provider Terms

8.1 Service Providers’ Use of the Platform

Service Providers who access the Platform (whether via direct email delivery of leads or via a portal/dashboard) agree to use Leads solely for the purpose of contacting the relevant Prospect in connection with a genuine enquiry about their dog services.

8.2 Service Provider Obligations

Service Providers agree that they will:

• Only use Lead information to make direct contact with the Prospect in relation to their enquiry;
• Not sell, transfer, or share Lead information with any third party without the express consent of the Prospect;
• Maintain appropriate security measures to protect Lead information;
• Comply with the Privacy Act 2020 in respect of any personal information received from Dog Trainer Index;
• Not add Prospects to any independent marketing list without first obtaining the Prospect’s direct and informed consent; and
• Promptly delete or return Lead information upon request by Dog Trainer Index or the Prospect.

8.3 Representations by Service Providers

Service Providers represent and warrant to Dog Trainer Index that:

• They are a legitimate and lawfully operating business or sole trader;
• They hold any required licences, registrations, or certifications relevant to their services;
• All information they provide to Dog Trainer Index is accurate and not misleading; and
• They will conduct themselves professionally and in good faith in their dealings with Prospects.

8.4 Advertising and Paid Placement

Service Providers who purchase advertising or premium placement through Dog Trainer Index agree to additional terms as provided at the time of purchase. Advertising content must be accurate, not misleading, and comply with the Fair Trading Act 1986. Dog Trainer Index reserves the right to reject or remove any advertising content that, in our reasonable opinion, breaches applicable law or our content standards.

Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is owned by or licensed to Dog Trainer Index and is protected by New Zealand and international copyright laws. You may not reproduce, distribute, or create derivative works from any content on the Platform without our prior written consent.

By submitting information to the Platform, you grant Dog Trainer Index a non-exclusive, royalty-free licence to use that information for the purposes described in these Terms and our Privacy Policy.

Disclaimer of Warranties and Limitation of Liability

10.1 Platform Provided ‘As Is’

The Platform is provided on an ‘as is’ and ‘as available’ basis. While we take reasonable care to ensure the Platform operates correctly and that Service Providers are legitimate, we do not warrant that:

• The Platform will be uninterrupted, error-free, or secure;
• Any Service Provider will contact you or provide services of a particular quality; or
• The Platform will meet your specific requirements.

10.2 Consumer Guarantees Act

Nothing in these Terms is intended to limit any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be excluded or limited by contract. If you are acquiring our services for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply.

10.3 Limitation of Liability

To the maximum extent permitted by law, Dog Trainer Index’s total liability to you in connection with these Terms or your use of the Platform is limited to NZD $100 or the amount you have paid to us in the 12 months preceding the relevant event, whichever is greater.

We are not liable for any indirect, consequential, incidental, special, or punitive loss or damage arising from your use of the Platform, your reliance on any Service Provider, or the conduct of any Service Provider.

10.4 Third Party Service Providers

Dog Trainer Index is not liable for any act, omission, or failure of any Service Provider. Any dispute regarding services provided by a Service Provider must be resolved directly between you and that Service Provider. We encourage you to exercise your own judgement when selecting a Service Provider.

Privacy

We are committed to protecting your personal information in accordance with the Privacy Act 2020. Our Privacy Policy (available on the Platform) sets out in detail how we collect, use, store, and disclose your personal information, and forms part of these Terms. Key points include:

• We collect personal information directly from you when you submit an enquiry;
• We disclose your information to Service Providers as described in these Terms;
• We may use your information to send Marketing Communications where you have consented;
• You have the right to access and correct your personal information held by us; and
• We retain your information in compliance with applicable law and your communication preferences.

Termination and Suspension

Dog Trainer Index reserves the right to suspend or terminate your access to the Platform at any time, without notice, if we believe you have breached these Terms or are using the Platform in a manner that is unlawful or harmful.

You may cease using the Platform at any time. To request deletion of your personal information, please contact us at privacy@dogtrainerindex.co.nz.

Governing Law and Dispute Resolution

These Terms are governed by the laws of New Zealand. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the New Zealand courts.

We are committed to resolving disputes fairly and promptly. If you have a complaint, please contact us in the first instance at hello@dogtrainerindex.co.nz. We will endeavour to respond within 10 working days.

If a dispute cannot be resolved informally, either party may refer the matter to mediation before commencing court proceedings.

General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dog Trainer Index regarding use of the Platform.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: A failure by Dog Trainer Index to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time.
• No Agency: Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and Dog Trainer Index.
